0. Parties to the Agreement
The Service Provider is MICODE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (MICODE Ltd.), with registered office at ul. Jana Heweliusza 11/811, 80-890 Gdańsk, Poland, entered in the National Court Register (KRS) under number 0001108050, NIP: 5833510147, REGON: 528740633 (hereinafter: "Service Provider"), operating the eKsięgowy AI service at https://eksiegowyai.pl. The User is any individual, legal entity, or organizational unit without legal personality using the Service.
1. Acceptance of Terms
By accessing and using eKsięgowy AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Services
eKsięgowy AI provides AI-powered accounting assistance, including but not limited to: financial data analysis, invoice management through wFirma integration, document generation, and AI chat functionality for accounting queries.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during registration and to update your information as needed. You are responsible for all activities that occur under your account.
4. API Keys and Third-Party Services
You may provide your own API keys for AI providers (OpenAI). You are responsible for securing these keys and for any charges incurred through their use. We encrypt stored API keys but cannot guarantee absolute security.
5. wFirma Integration
If you connect your wFirma account, you authorize us to access your wFirma data on your behalf. We will only access data necessary to provide the Service. You are responsible for ensuring you have the right to share this data with us.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by eKsięgowy AI and are protected by international copyright, trademark, and other intellectual property laws.
7. Limitations of Liability
The Service is provided "as is" without warranties of any kind. We are not liable for any financial decisions made based on AI-generated advice. Always consult with a qualified accountant for important financial matters.
8. Termination
We may terminate or suspend your account at any time, without prior notice, for conduct that violates these Terms or is harmful to other users or the Service.
9. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service.
11. Complaints Procedure
Complaints regarding the Service may be submitted electronically to the Administrator's e-mail address. A complaint should include: name or company name, e-mail address, description of the issue. We will process complaints within 14 business days of receipt, in accordance with applicable Polish consumer protection law.
12. Governing Law and Jurisdiction
These Terms are governed by Polish law. Any disputes arising from or related to these Terms shall be resolved by the common courts of the Republic of Poland with jurisdiction over the Service Provider's registered office, subject to consumer protection provisions.
